Eden's Nurturary, LLC, referred to as "we," and "our company," is committed to protecting your privacy. Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. Wix.com has a dedicated security team and privacy professionals who maintain and improve this hosting site's defense systems, and actively can their platform and infrastructure for security threats. Additionally, they monitor for suspicious activity in their network and address infrastructure security threats, and perform routine security assessments and audits. Wix.com services are hosted on AWS and Google Cloud Platform cloud-based data centers, for which Equinix provides all physical colocation services. Wix.com's infrastructure providers are certified as ISO 27001, ISO 27017, ISO 27018, SOC 1, SOC 2, SOC 3 and PCI DSS Level 1. In using Wix.com's web hosting platform, we follow industry standards on information security management to protect sensitive user information. Eden's Nurturary, LLC's website is encrypted using Hypertext Transfer Protocol Secure (https), Transport Layer Security (TLS) v.12, and firewalls. However, no method of transmission over the internet, or method of electronic storage is 100% secure. Therefore, Eden's Nurturary, LLC is unable to guarantee absolute security of your personal information. All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers

Collection of Personal Information

We use third party customer relationship management (CRM) platform, such as Dubsado, on our website to obtain and collect your personal information (i.e., full name, phone number, email, city, state, estimated due date, where you will be giving birth, your medical care provider, current pregnancy experience, birth vision, and any further details you may provide). This information is not covered by the Wix.com's privacy policy; however, Dubsado's privacy policy

collected and securely stored on the third party website when you submit a contact/inquiry form to schedule your complimentary consultation with Eden's Nurturary, LLC.

We receive, collect and store any information you enter on our website or provide us in any other way, and our CRM. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; client portal password; computer and connection information and purchase history (when using the store). We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, portal password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile. When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

We collect non-personal and personal information to provide and operate services; to create aggregated statistical data and other aggregated data and/or inferred non-personal information which we may use to improve our services, website functionality, and/or customer experience when interacting with this website, and to apply with applicable laws and regulations.

Communication

We may contact you regarding your account, to troubleshoot problems with your account or purchases, to resolve a dispute, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, or text message.

California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. Eden's Nurturary, LLC's privacy policy is linked on our home page or as a minimum on the first significant page after entering our website. Our Privacy Policy link includes the word ‘Privacy’ and can be easily be found on the page specified above. Users will be notified of any privacy policy changes on our Privacy Policy page. Users are able to withdraw consent by emailing us or through postal mail.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

Eden's Nurturary, LLC does not specifically market to children under 13.

Third Party Integration Privacy Policy

Dubsado is self certified with Privacy Shield Certification. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Dubsado has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, Dubsado commits to resolve complaints about our collection or use of your personal information.

Dubsado has committed to refer unresolved privacy complaints under the Privacy Shield to an independent dispute resolution mechanism, established by JAMS. With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Dubsado is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. If there is any conflict between the Privacy Shield principles and this Policy, the principles will govern. What personal information does Dubsado collect from users of their website?

Dubsado provides services that allow customers to manage various aspects of their businesses online. This includes client management, client relation and workflow automation services. In order to provide these services, Eden's Nurturary, LLC may be required to collect basic identification information including your name, address, phone number and email address when registering a new client account. Dubsado may also request information necessary to complete via client import or form building services and features. This could include the name, client name, address, phone number or email address of contacts that you disclose. All information provided for the sake of account building, be that important contacts or building forms is used strictly for the purposes Eden's Nurturary, LLC have instructed.

When does Dubsado Collect Information?

Dubsado may collect information from you when you interact with them by submitting a contact/inquiry form through Eden's Lullaby Fertility & Birth Nurturing, LLC. The personal information that you submit through the contact/inquiry form will then be securely stored in Dubsado's CRM program.

How Dubsado Uses Your Information

Dubsado automatically securely stores your information within Eden's Nurturary, LLC's CRM suite. Dubsado does not allow third-party behavioral tracking.

Sub-Processors

Dubsado is responsible for the processing and handling of personal data it receives under the Privacy Shield Framework, including the onward transfer liability provisions. In order to allow services on our behalf, Dubsado may share data about visitors and customers with our contracted service providers. Service providers are only authorized to use personal information necessary to complete the services requested. Dubsado may also share Data about Dubsado Visitors, Customers and Huddle Attendees with the Company’s service providers or partners to ensure information quality, and with third–party social networking and media Web sites, for marketing and advertising on said sites. Unless described in this Privacy Statement, Dubsado does not share, sell, rent, or trade any information with third parties for their promotional purposes. Our contracted service providers which provide services such as IT and system administration and hosting, credit card processing, research and analytics, marketing, customer support and data enrichment; such service providers comprise companies located in the countries in which we operate.

Compelled Disclosure

Dubsado may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Dubsado's Security

Dubsado's website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We do not use Malware Scanning. Eden's Nurturary, LLC 's personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. Dubsado implements a variety of security measures when a user places submits or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider and are not stored or processed on Dubsado's servers.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices as well as GDPR regulations Dubsado takes the following responsive action, should a data breach occur, they will notify Eden's Nurturary, LLC via email within 7 business days. Dubsado also agrees to the Individual Redress Principle and GDPR, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

Duration of Processing

Dubsado reserves the right to maintain your information for the length of time necessary to carry out intended services. This allows us to perform all necessary business operations, or meet any legal obligations.

Eden's Nurturary, LLC reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
